Terms of Service for HyperOrbit

Welcome to HyperOrbit, a tool provided by MindSafe Tech ("we," "our," or "us"). By accessing or using HyperOrbit (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. Eligibility

You must be at least 14 years old (or the age of majority in your jurisdiction) to use the Service. By using HyperOrbit, you represent and warrant that you meet this requirement.

2. Subscription Plans and Fees

2.1 Paid Subscription

HyperOrbit is a paid subscription tool. Access to the tool requires an active subscription plan. Details of available plans and pricing are displayed within the app or on our website.

2.2 Billing and Payment

• Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on the plan you select).
• Payment is processed through Apple App Store, Google Play Store, or other authorized payment platforms.
• All fees are stated in the currency displayed at the time of purchase and are inclusive of applicable taxes unless otherwise noted.

2.3 Auto-Renewal

• Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date.
• You may cancel auto-renewal at any time through your app store account settings or within the app.

2.4 Price Changes

We reserve the right to adjust pricing at any time. Any price changes will take effect at the start of your next billing cycle following notice of the change. Your continued use of the Service after the price change constitutes your agreement to pay the updated amount.

3. Free Trials

We may offer free trial periods at our discretion. At the end of the free trial, your subscription will automatically convert to a paid plan unless you cancel before the trial expires. You will not be charged during the trial period.

4. Refund Policy

4.1 App Store Purchases

If you subscribed through the Apple App Store or Google Play Store, refunds are subject to the respective store's refund policies. Please contact Apple or Google directly for refund requests.

4.2 Direct Purchases

For subscriptions purchased directly through our website:

• You may request a full refund within 3 days of your initial purchase if you are not satisfied with the Tool.
• Refund requests after the 3-day period will be reviewed on a case-by-case basis.
• Refunds will not be granted for partial billing periods or if your account has been terminated due to a violation of these Terms.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

• Use the Service for any illegal activity, including but not limited to unauthorized access to systems, distribution of malware, or copyright infringement.
• Attempt to disrupt, overload, or interfere with the Service or its infrastructure.
• Share, resell, or redistribute your account or subscription to third parties.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use the Service to transmit spam, phishing, or other unsolicited communications.

We reserve the right to suspend or terminate your account without refund if you violate these Terms.

6. Service Availability

6.1 Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control.

6.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

7. Intellectual Property

All content, trademarks, logos, and intellectual property associated with HyperOrbit are owned by MindSafe Tech. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your specific requirements.
• The Service will be uninterrupted, timely, secure, or error-free.
• The results obtained from the use of the Service will be accurate or reliable.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MINDSAFE TECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless MindSafe Tech and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

12. Termination

12.1 By You

You may cancel your subscription and stop using the Service at any time. Cancellation does not entitle you to a refund for the current billing period.

12.2 By Us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms or engage in conduct that we determine is harmful to the Service, other users, or third parties.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MindSafe Tech is registered, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration body in the jurisdiction of MindSafe Tech.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
